1. Scope and Acceptance
These Terms & Conditions ("Terms") govern access to and use of the website and online services operated by Stay Chill (the "Website"), an adult classified ads platform where verified advertisers post classified advertisements with or without pictures for promotional purposes.
By accessing the Website, creating an account, posting a classified ad, or purchasing credits, the user ("User" or "Advertiser") agrees to be bound by these Terms. If the User does not agree, they must not access or use the Website.
2. Eligibility and Age Verification
The Website is intended exclusively for adults who are at least 18 years old or equivalent legal age in their country.
All Users must confirm they are of legal age before accessing the platform and confirm they agree to the website’s terms and conditions and privacy policy. All users must undergo age/identity verification through approved age-verification providers (such as Yoti) before accessing the posting ads, or purchasing credits.
Users who fail age verification are denied access to ad posting and credit purchase functions. Falsifying identity or age information is prohibited and may result in account termination and legal action.
3. Advertiser Verification and Requirements
Only verified Advertisers may post classified ads or purchase credits on the Website.
Each Advertiser must:
- Successfully complete age/identity verification as outlined in Section 2.
- Provide valid identity documentation (as required by the verification provider) and confirm they are 18 or older.
- Enter into a written service agreement with Stay Chill by accepting these Terms.
- Confirm that they have obtained written consent from any person depicted in ad pictures and keep copies of such consent on record.
- Comply with all provisions of these Terms, including content standards and moderation requirements.
4. Credits and Promotion Services
Users purchase non-recurring credit bundles to promote classified ads (for example, to boost visibility, gain featured placement, or extend ad duration).
4.1 Credit Purchase Terms:
- Credits are sold in fixed bundles with prices clearly displayed at purchase.
- Credits do not auto-renew or recur; they are one-time, non-recurring purchases with no future billing or automatic charges.
- By completing a credit purchase, the User authorizes a single charge for the exact amount shown at checkout.
- Each transaction is independent and does not establish a recurring billing cycle.
4.2 Credit Usage and Expiry:
- Credits are applied to the User's account immediately upon successful payment.
- Unused credits expire after 12 months from the date of purchase.
- Expired credits are non-refundable and non-transferable and cannot be restored.
- Credits may only be used by the account holder and cannot be gifted, sold, or transferred to other users.
4.3 No Refunds on Credits:
- Once credits are purchased and/or applied to promote an ad, they are **non-refundable**.
- This is because credits are a digital service; once the promotion has been activated, the service has been delivered.
5. Allowed and Prohibited Content
5.1 Allowed Content:
Advertisers may post classified ads containing text and pictures of adults only (18+) in a respectful and consensual manner. Any attempt to post prohibithed content will not be tolerated, content will be permanently removed and account will be permanently banned.
5.2 Strictly Prohibited Content:
The following content is strictly prohibited and will be rejected by moderation without appeal:
- Images or depictions clearly showing genitalia or explicit sexual acts.
- Child sexual exploitation material or any content depicting, describing, or appearing to depict persons under 18.
- Forced, non-consensual, or exploitative sexual activity or depictions of individuals unable to give consent (drugged, unconscious, asleep, coerced, etc.).
- Bestiality or sexual activity involving animals, pets, or non-human creatures.
- Violence, mutilation, extreme violence, or hate crimes.
- Blood, menstrual blood, scat, or feces.
- Alcoholic beverages or illegal substances.
- Background persons without consent (must be completely removed, not blurred).
- Any content suggesting or promoting human trafficking, sex trafficking, or exploitation.
- Any illegal content or activity.
5.3 Content Moderation:
All ads and pictures are subject to manual and automated mandatory pre-publication moderationby Stay Chill. Content deemed to violate these standards will be rejected and not published; rejected content cannot be resubmitted. Users will be notified of rejection but moderation decisions are final and cannot be appealed.
6. Anti Modern Slavery & Anti-Trafficking Policy
Stay Chill maintains an absolute zero-tolerance approach towards modern slavery, human trafficking, sex trafficking, sexual exploitation, and forced or non-consensual labour.
6.1 Prohibited Use:
No User may use the Website in any way that:
- Promotes, facilitates, advertises, or benefits from human trafficking or sex trafficking.
- Involves forced, non-consensual, or exploitative sexual activity or depiction.
- Involves modern slavery, forced labour, debt bondage, or exploitation of any individual.
6.2 Advertiser Obligations:
By posting content, each Advertiser confirms and warrants that:
- All persons depicted in ad pictures are consenting adults (18+).
- No person in the ad was coerced, deceived, threatened, or exploited into participation.
- All content originates from consensual interaction and is not the result of trafficking or abuse.
6.3 Stay Chill's Response:
Upon receiving a credible report or identifying suspected trafficking or exploitation:
- Stay Chill immediately removes the ad.
- The associated account is terminated.
- Relevant information is reported to law enforcement and competent authorities where required or appropriate.
7. Third-Party Links Policy
Stay Chill does not generally permit Advertisers to include links in classified ads. However:
- All links are monitored for compliance.
- Any link found or suspected to host prohibited, illegal, or non-compliant content will be immediately removed
- Links to external platforms (e.g. cam sites) that are beyond Stay Chill's control and monitoring will be removed if they contain or may contain non-compliant content.
- Users follow third-party links at their own risk; Stay Chill is not responsible for third-party content.
8. User Conduct
Users agree not to:
- Violate any applicable laws or these Terms.
- Post false, misleading, or fraudulent information.
- Harass, threaten, defame, or abuse other Users.
- Engage in spam, phishing, hacking, or unauthorized access.
- Attempt to reverse-engineer, copy, or misuse the Website's technology or content.
Violations may result in immediate account termination and referral to authorities where appropriate.
9. Refund Policy
9.1 General Non-Refund Policy:
Credits and purchases are non-refundable once payment has been processed. This is because credits are a digital service; once the service has been delivered (the promotion has been made available or activated), a refund cannot be granted.
9.2 Exceptions:
Refunds may be considered in limited and exceptional circumstances only:
- Duplicate charges: If the same charge appears multiple times due to a technical error by the payment processor.
- Unauthorized use: If the User can prove the payment was made fraudulently or without authorization (subject to investigation and verification by the payment processor).
- Mandatory consumer law: If refunds are required under applicable Swiss or European consumer-protection legislation.
9.3 Refund Procedure:
To request a refund for one of the above exceptions, the User must:
- Contact customer support via [email protected] within **14 days** of the transaction.
- Provide transaction details, order number, and a detailed explanation.
- Cooperate with any investigation if required.
Stay Chill will review the request and respond via email within 7 business days. If approved, the refund will be processed to the original payment method.
10. Pricing and Billing Details
10.1 Pricing Transparency:
All credit bundle prices are displayed clearly on the Website in the applicable currency before checkout.
10.2 Billing Information:
- Purchases are one-time, non-recurring transactions.
- The User authorizes payment of the exact amount shown at checkout.
- No trial periods, introductory offers, or promotional periods are active (or if any are offered, their duration and end date will be clearly stated).
- No automatic or subsequent billing will occur unless the User explicitly purchases additional credit bundles.
10.3 Payment Processing:
Payments are processed through PCI-DSS compliant payment service providers and are subject to card-issuer and or relevant financial institution approval. By submitting payment information, the User authorizes Stay Chill and its payment provider to process the transaction as described.
10.4 Cardholder Information:
- Stay Chill does not store full cardholder data; payment processors retain this information under strict security standards.
11. Cancellation Policy
11.1 Ad Cancellation:
Users may delete or unpublish their classified ads at any time via their account dashboard or by contacting support. Once an ad is deleted, associated credits used for promotion are non-refundable.
11.2 Account Cancellation:
Users may request account closure at any time by contacting **[Insert support email]**. Upon closure:
- All ads are removed from the Website.
- The account and associated data are marked for deletion (subject to legal retention requirements).
- Unused credits are forfeited and cannot be refunded.
12. Complaints Procedures
Stay Chill operates two separate complaint processes, each with distinct timelines and procedures:
12.1 General Content Complaints (5 Business Days Resolution)
12.1.1 Eligibility:
Any person may report content believed to be illegal, policy-violating, or non-compliant with these Terms or applicable standards.
12.1.2 How to Report:
Submit a report to [email protected] including:
- The direct link (URL) or identifier of the reported ad.
- A brief description of the policy violation (e.g., prohibited content, misleading information, spam).
- Contact information (email or name).
12.1.3 Resolution Timeline:
Stay Chill reviews all complaints and aims to respond and take action (including content removal, moderation, or investigation) within 7 business daysof receipt.
12.1.4 Possible Outcomes:
- If the ad is found in violation, it will be removed or modified.
- The Advertiser may be warned or have their account restricted or suspended.
- The reporter will be notified (where possible) that action has been taken.
12.2 Non-Consensual Image or Illegal Content (24-Hour Removal)
12.2.1 Eligibility:
Any person depicted in a picture or described in a classified ad may request immediate removal if:
- The ad or picture was posted without their consent, OR
- The ad contains illegal content or activity.
12.2.2 How to Request Removal:
Submit a removal request to [email protected] including:
- The direct link (URL) to the ad in question.
- Sufficient information to verify that you are the person depicted or a duly authorized representative (e.g., identity confirmation, legal document).
- A clear statement that the content is non-consensual and/or illegal.
12.2.3 Verification:
Stay Chill will verify the claimant's identity and the validity of the claim. Verification is expedited but does require basic confirmation that the claimant is the depicted person.
12.2.4 Removal Timeline:
Upon receipt of a valid removal request, the ad will be permanently removed within 24 hours of verification. No further investigation into the circumstances is required before removal takes place.
12.2.5 Re-Upload Prohibition:
Once an ad is removed following a verified non-consensual or illegal claim:
- Re-uploading the same or substantially similar content is strictly prohibited.
- Violators may face permanent account termination and will be reported to law enforcement.
- Stay Chill maintains a database of removed content to prevent re-posting.
13. Data Security and Privacy
Stay Chill implements appropriate technical and organizational security measures to protect personal and payment data against unauthorized access, loss, or misuse. See the Privacy Policy for full details on data collection, use, and User rights.
14. Limitation of Liability
To the maximum extent permitted by Swiss law, Stay Chill is not liable for indirect, incidental, or consequential damages (including lost profits or data) arising from the use or inability to use the Website.
Nothing in these Terms limits liability where such limitation is prohibited under applicable Swiss law.
15. Changes to These Terms
Stay Chill may update these Terms from time to time to reflect legal changes, business updates, or technical improvements. The "Effective date" or "Last updated" date will be amended accordingly.
Continued use of the Website after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated to Users where feasible.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between the User and Stay Chill regarding use of the Website and supersede all prior agreements or understandings.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by and shall be construed in accordance with the laws of Switzerland, without regard to its conflict of laws principles.
Any dispute, claim, or disagreement arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lugano, Switzerland. Users waive any objection to jurisdiction or venue in such courts.
